ATLANTA (AP) – Georgia Attorney General Sam Olens says a criminal prosecution of a former state Department of Transportation official “would almost certainly not result in a conviction.”

Olens said in a letter Friday to Gov. Nathan Deal that his office is closing its investigation into former department treasurer Earl Mahfuz, who retired in April 2010.

The state auditor had found that the department was spending money unconstitutionally under Mahfuz and that he was abusing his authority by ordering staff to stop recording signed contracts in state computers.The state auditor had found that the department was spending money unconstitutionally under Mahfuz and that he was abusing his authority by ordering staff to stop recording signed contracts in state computers.

Mahfuz has denied any wrongdoing. Olens said he doesn’t condone Mahfuz’s behavior, but there’s not enough evidence to back up a criminal case.
